Leaving a West Campus lease: when does the debt end?

A relet fee can leave rent running until the replacement moves in. The resident and parent each need their release checked.

Research cutoff: . Prices, budgets and results keep their own dates.

In this investigation

Paying a relet fee may leave you owing rent until the replacement moves in. Rambler’s explanation makes that timing explicit. I would compare the written release condition before comparing exit fees: one extra rent installment can cost more than the difference between two advertised fees.

At an illustrative $1,200 installment, Rambler’s $500 resident-found-replacement charge is $700 below its one-installment property-found charge. Another month of liability costs $1,200. Finding someone, getting approval and being released need to happen in the right order.

A TAA student lease may allow 72-hour cancellation

If you just signed, check your lease and attachments first. Section 30 of the October 2025 TAA student form voids the lease without penalties when the landlord receives written cancellation within 72 hours of the date you sign, unless the landlord has received the first installment or you’ve been issued keys. Key issuance matters even before move-in; application and administration payments aren’t automatically the first installment.

Your signed packet must include that option. Section 32 lets special provisions, addenda and Community Policies override conflicting form terms. Check those and the instructions for delivering notice. This is a contractual option, not a statewide cooling-off rule; other operators can use different forms.

Rambler’s published relet explanation$500 if you find the replacement; one installment if management finds themThe approved replacement picks up keys and moves in; confirm the guarantor’s release too

Quarters’ current replacement policy$500 outgoing; $250 incoming application; $100 incoming deposit. Finish approval, papers and payment by the previous month’s 15th for a takeover on the 1stThe replacement addendum wasn’t obtained; resident and guarantor release need checking

Read Rambler’s relet explanation and Ion’s current sample alongside the proposed lease, guaranty, utilities and other attachments. Ion’s sample uses a $1 housing placeholder; it supplies no usable rent quote.

An internal transfer changes rooms within the property. A delegation brings another person into an obligation. A relet can create a replacement tenancy. Their labels don’t tell you whether the original resident or parent is released. Get that answer in the document everyone signs.

Individual rent can coexist with shared damage charges

An individual bedroom lease can protect you from another resident’s unpaid bedroom rent and still allocate common-area damage to several residents. A joint apartment lease can expose each signer to more than their intended share. The guaranty may extend a parent’s exposure further.

For each debt, look for the event that creates it and the people who can be billed. The important categories are rent, utilities, damage, violations, exit charges and collection costs. Calling the whole agreement an “individual lease” leaves too much unanswered.

The TAA student contract also allows certain payments to cover other unpaid charges before rent, with an exception for regulated water and wastewater bills. Paying the installment amount doesn’t guarantee that the ledger applies all of it to rent. Keep your payment confirmations and itemized account history.

A replacement should lead to a written release

Ion’s early-departure provision delays credit until all available bedrooms at the property have been assigned and occupied. That deserves a direct question about how replacement rent will be credited. Texas Property Code §91.006 imposes a nonwaivable duty to mitigate damages when a tenant abandons a lease in breach.

The sample clause doesn’t prove that Ion collected unlawful rent. A signed contract, qualified replacement offers, re-rental dates, receipts and the credits applied would make the question concrete. No decision on that exact provision was found in this research.

A statutory exit can also differ from a negotiated relet. Texas law provides conditional rights for specified military events, family violence, sexual offenses or stalking, certain deaths and casualty conditions. Graduation, withdrawal or a roommate disagreement doesn’t automatically create the same right. The required proof and notices depend on the provision involved.

The fee rules have different clocks

The fee rules have different clocks
Charge or eventRule to checkWhat the rule doesn’t promise
Late rentWritten lease; two full days of unpaid rent before collecting a late fee; reasonableness under §92.019A universal 10% maximum for every charge
Security depositGenerally refund/accounting within 30 days after surrender, subject to the written forwarding-address requirement and lawful deductionsAn automatic full refund for every missed deadline
Fee instead of a deposit§92.111’s agreement, insurance and deposit-choice conditionsInsurance for your possessions or forgiveness of your damage debt
Covered water/wastewater billGenerally at least 16 days to pay; agreed one-time late penalty at most 5%Permission to apply the rent-lateness rule to the water bill
Qualifying submetered water service chargeGenerally capped at 9%, with the rule’s exceptionsA blanket 9% allowance for every utility administration fee

The controlling sources are Chapter 92 and the PUC’s billing rule and service-charge rule. A qualifying repair can trigger notice and remedy rights, but seven days is a rebuttable reasonable-time presumption. It isn’t a promise that every defect must be repaired in a week, or permission to stop paying rent without following the law.

Austin’s 2026 fee-disclosure ordinance began its large-provider phase October 1, with the smaller-provider phase beginning January 1, 2027. The phase-in follows the provider’s dwellings rented, leased or managed, not necessarily one building’s size. Covered providers must disclose fees at the required quotation/application stage and include fixed mandatory recurring charges in advertised rent. Disclosure doesn’t turn the fee into a lawful price or guarantee a refund.

A court case isn’t a rating for an operator

In American Campus Communities v. Berry, the Texas Supreme Court reversed class certification over leases that lacked required repair-remedy information. The omission didn’t trigger the monetary penalties asserted. That distinction matters when choosing a remedy; it doesn’t make every ACC contract term enforceable.

The research also found a reported University House settlement and utility-billing submissions involving Moontower. A settlement or a party’s filing isn’t a decision that proves an allegation. No defensible building-by-building eviction rate was produced. Missing retrieved cases don’t mean an operator had zero filings.

The documents to collect before moving out

  • Your complete signed packet and every later amendment.
  • The current balance and itemized charges, with payment confirmations.
  • The approved replacement’s start date, paperwork and possession date.
  • A written statement releasing the resident and explaining the guarantor’s position.
  • Move-out photographs, key-return proof and your forwarding address sent in writing.

Ion’s sample also has a 30-day opt-out procedure for specified arbitration and class-waiver terms. That deadline belongs on your calendar when you sign, well before an exit dispute.

I would treat the release as the thing to buy. A fee is worthwhile only when you understand which work it pays for and which debts survive afterward.

How we got this

The November 2026 research compares 72 clause entries, 18 legal controls, available operator forms and published explanations. Ion’s 2027–28 sample, older Torre and Westside documents, and operator FAQs have different dates and authority. The complete current packet wasn’t available for every operator, and this isn’t a count of signed tenant contracts or court outcomes. The full manuscript below preserves those gaps and individual sources. UT’s current consultations page lists alternatives while new Legal Services appointments are unavailable.
